Vhong Navarro surrenders to NBI after arrest warrant for acts of lasciviousness issued. My notes on bail (applicable to all who might get arrested for any reason by any manner)
1.You can post bail even before a warrant of arrest is issued, the posting of bail is not a waiver of your right to question the legality of any arrest made at any time, so, bail is my recommended remedy more than anything else: Prevent getting unjustly jailed, or get yourself out of an unjust detention in a matter of hours or days.
2.Caution (Mag-ingat) : Halimbawa: May abogado na baka ang sabihin sa iyo ay ang isasampa nyo ay petition for the writ of habeas corpus sa halip na bail. (there might be instances when a lawyer would tell you that you will file a petition for the writ of habeas corpus instead of bail.). Alalahanin: Maaaring umabot ng isang taon hanggang limang taon o sampung taon bago maglabas ang Supreme Court ng resolusyon sa Petition for the writ of habeas corpus mo. Gusto mo, nakakulong ka ng limang taon nang wala pang katarungan kasi nililitis pa ang kaso? Kung sabihin nya sa iyo ito, sabihin mo: "Hindi, attorney, ayaw kong nakakulong ako, magpipyansa ako, sa ilalim ng Revised Rules of Court, ang pagpyansa ay hindi nangangahulugan na isinuko ko ang karapatan na hamunin ang legalidad ng ginawang pagkulong, kaya unahin nyo po ang pag-asikaso sa pyansa ko".
If your lawyer insists that you will not file bail but instead go to the Supreme Court on petition for habeas corpus, I'm telling you: the Supreme Court will take more than a year to resolve it, in some instances, five to ten years, during that time you are in jail for the whole time, for one to five to ten years and you could get sick inside the jail in those five years and die. POST BAIL, you will be freed in 2 to 3 working days without prejudice to challenging the legality of the arrest as provided in the rules.
3.Kung ayaw ng abugado mo na asikasuhin ang pyansa mo at mag-insist sa ibang remedy tulad ng petition for the writ of habeas corpus habang nakakulong ka na tatagal ng mula isang taon hanggang limang taon / sampung taon kasi ganuon katagal maglabas ng resolusyon ang Supreme Court: Magpalit ka ng abugado, mas mahalaga ang buhay ko keysa sa feelings ng abugado mo. Listen to this advice if you want to live.
4.If you don't have money for the cash bail bond, apply for a surety bond which will undertake your cash bond, you will pay the surety bond only about ten percent of the cash bond (this fee however will no longer be returned to you as it is goes to the surety for undertaking or guaranteeing that you will appear in court. But in the meantime, you are freed) So, no worries: Look for a surety bond agent in the court premises, ask your lawyer to look for one, ask the court personnel where you can find one. Walang dahilan para nakakulong ka habang nililitis ang kaso mo at wala pang napapatunayan ukol sa iyo. Got it? Hanapin mo ang surety bond agent, dahil ten per cent lang ang kelangan mong bayaran, ang surety bond agent ang bahala sa buong halaga ng cash bond.
5.Your priority is not to be unjustly jailed, your goal is to be freed if in detention. Everything else follows after that. Keeping alive your struggle after you are freed follows that. Live to fight…
And to do that, we have to get you freed and alive.
