Obstruction  of justice complaint vs. father of POI in Salilig case scrapped

"I haven't read  resolution myself… all I know is that  resolution was for dismissal. ..it did not reach level of probable cause with reasonable certainty of conviction,"

Department of Justice prosecutors have dismissed  complaint for obstruction of justice against  father of person of interest in  death of alleged hazing victim John Matthew Salilig.

Justice spokesman Mico Clavano said  complaint against father was dismissed for lack of probable cause with reasonable certainty of conviction.

The Justice Department has recently raised  standard of evidence provided in cases with Justice Secretary Jesus Crispin Remulla ordering prosecutors to recommend  withdrawal of pending criminal cases that have no reasonable certainty of conviction in first-level courts.

Clavano said  father will be released immediately.

Asked if  Biñan City Police has already been informed, Clavano said, "I'm not sure if they've been informed although this is the latest updated that I got from  panel of prosecutors."

The body of  24-year-old chemical engineering student Salilig was found Tuesday in  shallow grave in Imus City, Cavite .

On Thursday, Biñan City Police filed  complaint against  father for obstruction of justice and  complaint for violation of the Anti-Hazing Law against six individuals linked to  death of Salilig.

According to Clavano, seven have already surrendered out of 15 persons of interest in the case, including  alleged master initiator who surfaced on Thursday.

Earlier, police authorities said three more persons of interest have inquired about  procedures for surrender.

"Siguro ang message na lang po natin sa mga schools, school authorities,  barangay officials is to cooperate in, I guess, hunt for  rest of  respondents who have been identified already, so we encourage  school authorities to help our law enforcement agencies if ever there are requests for any information sa school to please cooperate so that we can get to  bottom of this case as soon as possible" Clavano said.

Three more persons of interest in the death of Adamson University chemical engineering student Salilig have expressed  their intention to surrender, police said Laguna Provincial Police director Police Colonel Randy Silvio said three persons of interest have inquired about  procedures for surrendering.

"I think mga tatlo na 'yung nagtatanong sa akin kung papaano sumuko, sabi lang namin mag-proceed lang sa Biñan or doon sa malapit na police station para hindi na sila matakot, escort-an na sila papuntang Biñan City Police", Silvio said.

Biñan City Police acting chief  Police Lieutenant Colonel Virgilio Jopia said  police are expecting more or less two persons of interest to surrender soon, possibly within the day.

"Meron po tayong inaasahang mag-surrender dito sa ating himpilan, more or less dalawa po," Jopia said.

Currently, there are still 10 persons of interest in the death of Salilig allegedly due to hazing who are still at large.

Seven persons of interest are already in police custody , six who have already been slapped with complaints and one who surrendered to authorities on Thursday.

According to Jopia,  police already obtained  addresses of  remaining persons of interest.

"Kapag sila po ay sumerrender, i-undergo po natin sila ng investigation dito at titingnan din po natin ang kanilang criminal liability or criminal extent noong participation nila dito sa kasong ito," he said.

He said two of  10 persons of interest also underwent welcoming rites with Salilig in Biñan City, Laguna on February 19. The three were already members of Tau Gamma Phi but were transferring to  Adamson University chapter.

"Lalakad po ang ating imbestigador para puntahan 'yung ating dalawang biktimang na-initiate din po noong araw na yun," said Jopia.

Jopia said  two would be considered suspects if they would not present themselves to authorities to help shed light on the incident.

"Kasi kung hindi sila mag-come out at ifa-file natin sabay-sabay itong kaso, mako-consider silang suspek na rin," he said.

Meanwhile, Philippine National Police vowed to resolve the matter.

"We want to assure yung CHED, pati na rin yung ating mga kababayan at ilang mambabatas na hinihimok ang PNP na tutukan ang kasong ito, asahan po ninyong gagawing lahat ng PNP ang makakaya within its authority and mandate para resolbahin at tapusin ang kasong ito," PNP spokesperson Police Colonel Jean Fajardo said at public briefing.

The PNP issued  remark after  Commission on Higher Education (CHED) urged  police to expedite  investigation into death of Salilig so that proper charges would be filed against  perpetrators.

Neophyte Roi dela Cruz, a complainant and witness who earlier coordinated with  police, also underwent initiation rites on the same day.

Jopia said the police are now looking for  second vehicle that was used to transport Salilig's body.

Police investigators earlier obtained first vehicle used to transport  fraternity members involved in the hazing. It was found in the house of the parents of one of the suspects, Aaron Cruz, in Parañaque City. It was tagged as evidence by  police.

According to the police, Salilig sat on the passenger side of  SUV. When the suspects noticed that he was already lifeless, they transferred him to the compartment of  second vehicle.

A suspect gave  location of the paddle that was used on Salilig, which he said was already burned. However, Jopia said  police failed to locate it when they went to the area.

According to Silvio,  father of one of the persons of interest, Aaron Cruz, had said that he would surrender his son to authorities.
