Trio files copyright infringement charges vs TAPE, GMA

"It is not copyright infringement… Eat Bulaga name, design of name and logo is trademark and not subject of copyright," TAPE's legal counsel Maggie Garduque addressed statement regarding complaint TAPE Inc. has registration of tradename Eat Bulaga so they cannot file infringement against registered owner of trademark.
Original "Eat Bulaga" hosts Tito Sotto, Vic Sotto and Joey de Leon, collectively known as TVJ, have filed complaint for alleged copyright infringement and unfair competition against "Eat Bulaga" producer Television and Production Exponents (TAPE) Inc. and media giant GMA Network, airs "Eat Bulaga."
TVJ filed complaint June 30,2023, after TAPE and GMA aired and replayed some"Eat Bulaga" episodes without trio's consent.
On July 12, TAPE and GMA reportedly received summons from Marikina Court, requiring them to file answer to complaint within 30 days.
It can be recalled last May 31, TVJ and rest of Dabarkads or their "Eat Bulaga" co-hosts came to work but were not allowed to go live by TAPE. Instead, TAPE and GMA played past episodes of show.
Right after, TVJ and Dabarkads filed their mass resignation from TAPE and signed deal with MediaQuest Holdings Inc. to move in TV5 with new noontime show, "E.A.T.," which premiered July 1.
In his latest press interview, former senator Tito Sotto said TAPE has no right to celebrate "Eat Bulaga's" 44th anniversary this coming July 29.
Television and Production Exponents (TAPE) Inc. responded to Tito Sotto, Vic Sotto and Joey de Leon's copyright infringement and unfair competition complaints filed against them.
"Their petition for cancellation of trademark of Eat Bulaga is still pending before IPO and until such time said petition is granted, trademark Eat Bulaga and EB will be owned by TAPE Inc," she stressed.
GMA-7, who also included in complaint, also issued a statement.
"We will refer complaint to our legal counsel, Belo Gozon Elma Parel Asuncion and Lucila Law Offices," network said in statement.
