James Joseph Luckenbach, 33, of Lampasas, Texas, United States has been arrested by the Burnet County Sheriff's Office. He was charged with capital murder of multiple persons.

At around 1:00 p.m. on August 30, 2021, Burnet County Sheriff's Office deputies responded to a residence at The Overlook subdivision in Horseshoe Bay, Texas and found a man, 42, and a woman, 39, dead. The two were taken to the Travis County Medical Examiner's Office for autopsies.

The names of the two deceased persons were not released. Luckenbach is accused of killing the two unnamed victims.

It is unknown whether or not Luckenbach knew the two deceased persons no other details about the alleged double murder were released. On September 2, 2021, Burnet County Sheriff's Office deputies arrested him.

Luckenbach was booked into the Burnet County Jail in Burnett, Texas where he remains held without bond. The charges against him will be forwarded to the 33rd/424th District Attorney's Office for prosecution.

In Texas, murder is elevated to a capital offense when the murder occurs under specific circumstances. One of these is when the killing occurs during the commission or attempt of kidnapping, burglary, aggravated sexual assault, arson, obstruction or retaliation or terroristic threat.

Also, a person who intentionally or knowingly kills more than one individual during a single course of criminal conduct will be charged with capital murder, which carries a penalty of life in prison without parole or the death penalty. In Texas, the jury must decide two special issues in a death penalty case, which are whether the defendant is a future danger and if there are mitigating factors that would make a life sentence more appropriate.
