Makati to defend "embo" bgys before SC
By J.Lo
"We received document setting our omnibus motion for hearing…that means it is not yet final…part of our motion is to go before en banc and have oral arguments,"Makati City Mayor Abby Binay told media on sidelines of e CityNet Disaster Cluster seminar held at Dusit Thani hotel.
Makati City government is ready to defend its territorial jurisdiction before Supreme Court (SC) en banc and hold oral arguments over its land row with Taguig City.
Binay said city's legal team has received notice from SC for setting of hearing on city's urgent motion to elevate case before all magistrates.
Even though SC "wrote finis" to issue and sided with Taguig's historical claim over "embos" or "enlisted men's barrios" barangays in second district of Makati, Binay said fight is not yet over.
Department of the Interior and Local Government (DILG) has not instructed Makati to turn over embo barangays to Taguig, Binay said.
Binay admits she shed tears after high court in April confirmed entry of judgment of its special third division's December 2021 decision denied Makati's appeal on Taguig's win through petition for review.
In statement, SC t had written "finis" to tug-of-war over embo barangays as well as military reservation Fort Bonifacio, where 240-hectare lifestyle hub and financial center Bonifacio Global City is located.
Binay said 200,000 residents in embo barangays stand to lose their perks in Makati if their residential area is transferred to Taguig.
"This case has been ongoing since '90s…we don't know when this will end…at end of day, my thoughts are with my constituents affected. ..I have shed tears about this…as far as I know,.. Taguig has written DILG to enforce decision…but as far as Makati is concerned, it is status quo" Binay concluded.
